Employee invention law

In Germany the right to an invention made by an employee in the company is regulated by the “Law relating to Employee Inventions” (ArbnErfG). Unlike some other countries, here the right to an invention by an employee does not automatically fall to the employer. An in-depth knowledge of the legal regulations is a prerequisite for establishing company procedures so as to ensure a transfer of the property rights to the employer which is as easy as possible, practical but legally secure.
